 | In the spring of 2023, at the direction of Department of Justice (DOJ) leadership, Access to Justice (ATJ), Federal Bureau of Prisons (BOP), and the U.S. Marshals Service (USMS) conducted a review of structural and procedural challenges to access to counsel and e-discovery in BOP’s ten standalone pretrial detention facilities. On July 20, 2023, the Deputy Attorney General released a report that (1) recognizes a pretrial detainee’s rights to confidential attorney-client visits, phone calls and correspondence, and to review e-discovery; (2) examines deficiencies in these areas; and (3) makes recommendations to cure the deficiencies. While the report focuses on access to counsel and e-discovery issues in federal BOP facilities, it can serve as a helpful resource for those facing similar challenges in state and local facilities. |
